1. Unofficial Application
Hello # ("the App") is an independent, third-party application. It is not developed, endorsed, affiliated with, or supported by smart Europe GmbH or any of its subsidiaries. All vehicle trademarks belong to their respective owners.
2. Acceptance of Terms
By downloading, installing, or using the App, you agree to these Terms and Conditions. If you do not agree, you must uninstall the App immediately.
3. Use at Your Own Risk
The App communicates with vehicles through undocumented APIs. You acknowledge and accept full responsibility for any unexpected vehicle behavior that may result from its use, including but not limited to locking, unlocking, or digital key functions.
4. No Warranty
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, regarding uninterrupted function, security, accuracy, or error correction.
5. Limitation of Liability
To the maximum extent permitted by law, the developer shall not be liable for vehicle damage, unauthorized access, loss of keys, personal injury, or data loss, regardless of legal theory or prior notice of potential damages.
6. Irreversible and Destructive Actions
Certain features perform irreversible operations, including digital key deletion. Consequences may have effects beyond what is described, and you bear sole responsibility for understanding and initiating such actions.
7. Digital Key & Vehicle Control
These features rely on connectivity and external services which may fail or become unavailable at any time. You should always carry your physical key or official means of vehicle access as a backup.
8. smart Europe GmbH Services
Third-party services used by the App may change or be discontinued without notice. The developer assumes no responsibility for disruptions caused by such changes.
9. Account Credentials
Your account credentials are stored locally on your device and are never collected by the developer on external servers.
10. Updates and Changes
The developer may modify or discontinue the App at any time. Continued use of the App following any revision constitutes acceptance of the updated terms.
11. Indemnification
You agree to indemnify and hold the developer harmless from any claims and legal expenses arising from your use of the App or violation of these terms.
12. Governing Law
These terms are governed by French law, with exclusive jurisdiction granted to French courts.
13. Severability
If any provision of these terms is held invalid, the remaining provisions shall continue in full force and effect.
